3 Keys to Compensation in a Rape and Sexual Abuse Case

We understand the severity of what you’ve experienced. Our job is to help you heal and advocate for your rights.

Here are three keys to compensation in rape and sexual assault cases.

1. Notice of similar crimes in the past.

If the claim is against someone other than the perpetrator, most of the time you will have to prove the defendant knew or should have known about the risk of rape or abuse. This can be done by showing the property has had similar crimes in the past, or that the property owner was aware the perpetrator was trouble.

2. Well-documented damages.

Unfortunately victims of rape and sexual abuse are frequently ignored or disbelieved. To combat this, we advise our clients to seek medical treatment, whether that be mental or physical treatment. The victim should also report the rape or sexual abuse to the right authorities. These things generate records which can be used to prove your case.

3. Collectability.

The only remedy we can obtain for our clients is money compensation. We cannot send perpetrators to jail or charge them with crimes. While money compensation can bring a sense of vindication, that’s not something we can guarantee. Because of this, we need to be able to collect any money judgment we get from the perpetrator or those liable for the rape or sexual abuse. This usually means the defendant must have insurance or the means to pay. An uncollectible judgment is only worth the paper it’s printed on.

Through our decades’ worth of experience handling rape and sexual abuse cases, we know how to open the door to money compensation in them. If you or a loved one have been a victim of such a crime and have questions about getting money compensation, please contact our firm. We are Kansas City personal injury lawyers, and we can help.
