When Should You Hire a Lawyer After an Assault?

What to Do if Someone Physically Assaults You

Injuries from assaults can be serious or fatal. When someone intentionally hits you or causes you harm, the injuries can range from concussions to broken bones to death. As a personal injury lawyer handling all types of assault claims in Kansas and Missouri, including sexual assault, I have seen my fair share of these types of cases and am an experienced assault attorney. Here’s are some things I think you should look out for when considering hiring a lawyer when someone physically assaults you.

Does the Perpetrator Have Any Assets?

Unless you can show that the perpetrator was on-the-job at the time of the assault, you’re going to be left collecting compensation from the perpetrator themselves. Generally speaking, assaults are not covered by insurance. There are exceptions to this rule, but when considering hiring a lawyer to get money compensation from your injuries from an assault, it is important to know whether the perpetrator has any way to pay compensation.

What Happens When You Press Charges on Someone for Assault?

If the perpetrator has enough assets to pay money compensation, or if the assault is covered by insurance (either through the perpetrator’s employer if it was an on-the-job assault or through the perpetrator’s own insurance), then I advise that you press charges. Criminal charges help with a personal injury claim and can increase the value of your case. Pressing charges can also hold the perpetrator accountable and help prevent future incidents.

Is It Worth Pressing Charges for Assault?

If the assault happened at a business or work site, find out whether the property owner knew, or should have known, that there could be an assault. If so, then the property owner may be liable to pay you money compensation for your injuries. Pressing charges can also be a critical step in proving negligence if a third party, such as a business, failed to provide adequate security or prevent a foreseeable attack.
